Terms of Service
These terms govern your use of PESR Control Center. We've tried to write them to be read, not skimmed.

1. Who provides the service
The service is provided by MYK, established in Québec (“we”). Our full particulars are provided on request, at the address given at the foot of this page.
“You” means the driving school subscribing to the service, and the people you authorise to use it.
2. No connection with the SAAQ
PESR Control Center is independent software. We are not affiliated with, endorsed by, authorised by, accredited by or acting for the Société de l'assurance automobile du Québec (SAAQ). No connection of any kind exists between us and the SAAQ.
“PESR” names the Programme d'éducation à la sécurité routière, which the SAAQ governs. We use it to describe what the software helps you track, never to imply official approval.
SAAQ requirements can change without our being told. Always confirm with the SAAQ itself.
3. What the service does — and does not do
The service is management and guidance software: it helps you track your student files, deadlines and proofs, and makes compliance easier to keep on top of.
It does not guarantee your compliance, does not certify it, and is not a substitute for it. The service is provided “as is”, without warranty of any kind, express or implied, including any warranty of merchantability or fitness for a particular purpose, to the extent permitted by law.
Your school's compliance, the accuracy of its records and the decisions it makes remain its own. We are not legal counsel.
The software flags what it can detect from the data you enter. It cannot detect what isn't there.
4. Your account
You are responsible for the accuracy of the information given at signup, for keeping passwords confidential, and for what your school's accounts do.
You agree to grant access only to people who need it, and to remove access when someone leaves your school.
5. Trial, subscription and billing
The subscription begins with a free 8-week trial, starting when your signup is approved. Nothing is charged during the trial; a card is saved with Stripe at signup so the subscription can continue without interruption.
Payments are processed by Stripe, which alone holds your card details. We never see, handle or store your card number; our servers never receive a copy of it.
The rate that applies is the one shown when you convert, and it stays guaranteed for as long as the subscription remains active and uninterrupted.
The subscription includes up to 300 active students. Beyond that, creating new files is blocked until files are closed or a higher plan is agreed; nothing extra is billed without your agreement.
Applicable taxes are added where we are required to collect them.
6. Cancellation
You may cancel at any time. Cancellation takes effect at the end of the period already paid for; started periods are not refunded pro rata, except where the law requires it.
We may suspend or terminate an account for non-payment, unlawful use, or use that compromises the security of the service — in the last case, without notice.
Before and after cancellation you can export your data to CSV, at any time, without having to write to us.
7. Your data is yours
The information you enter remains yours. We do not sell it, rent it, or use it for advertising or to train an artificial-intelligence model.
We process it solely to provide the service, as a mandatary under Law 25. A separate written mandate governs that relationship; ask us for it.
You remain the party responsible, in law, for your students' personal information — including the lawfulness of collecting it and answering access requests.
8. Availability
We aim for continuous availability but do not guarantee it. The service may be interrupted for maintenance, or by the failure of a provider we depend on.
No service-level agreement is offered at this time. If that changes, it will be written here.
9. Limitation of liability
The service is provided “as is”. To the extent permitted by law, our total liability to you, for any cause, is limited to the amount you paid us in the twelve months preceding the event.
We are not liable for indirect losses, including loss of SAAQ recognition, a fine, or lost business.
Nothing here excludes liability that cannot be excluded under Québec law.
10. Changes
We may change these terms. For a material change we will give you at least 30 days' notice by email. Continuing to use the service after it takes effect means you accept it.
11. Governing law
These terms are governed by the laws of Québec. Any dispute falls to the competent courts of Québec.
